A scrap metal businessman has been forced to close down after being prosecuted by the council.
Mumtaz Khan pleaded guilty at Hyndburn Magistrates Court to running the business at Unit 5 on Alliance Street in Baxenden without the required licence.
The magistrates also heard and granted Hyndburn council’s application for a closure order on the premises.
Khan, 44, of Higher Antley Street, Accrington, was given a three-month conditional discharge, ordered to pay £50 costs and given a closure order.
Coun Clare Cleary said they had ‘no option but to take him to court’ after he failed to comply with the requirements of the Scrap Metal Dealers act, which came into force in 2013.
She said: “Officers had been in touch with Mr Khan on several occasions to inform him that he needed the licence to operate his business, as to run a scrap metal business without one is breaking the law under legislation which came in to force in 2013.
“However, Mr Khan failed to complete his licence application, which meant he was operating in breach of the law, leaving the council no option but to take him to court.”
