A thirty-nine-year-old man has been cleared of raping a mother as her children slept upstairs in their beds.
Linden Aquilina, of Earl Street, Clayton-le-Moors, was found not guilty of the allegation, after a seven-day trial at Burnley Crown Court. He was discharged from the dock by Judge Jonathan Gibson.
The jury had heard after the alleged incident last Easter Saturday, the woman was said to have been upset, crying and at one point hysterical.
She told the jury that she had thought that the defendant had wanted to get to know her and that she had not been offering sex.
The hearing had been told how the night after the woman claimed she had been raped, she had gone on a girls' night out and had not reported what she claimed happened until the next day.
